A complete, dedicated guide to how Dakdan Talent collects, uses, and protects your data as a student-athlete — including NIL data, AI processing, and your full rights.

1What Athlete Data We Collect & Why

Dakdan Talent collects athlete-specific data to power three core services: career recruiting, NIL deal management, and brand value development. Every data point we collect has a specific, documented purpose. Here is a full accounting:

Athletic Identity Data

What: Sport(s), position, division level (NCAA D1/D2/D3, NAIA, NJCAA, high school), school/team name, eligibility year, jersey number, physical attributes relevant to sport.

Why: To match you with employers and opportunities that fit your sport schedule, division, and athletic profile. This is the foundation of our athlete recruiting feature.

Performance & Statistics

What: Sport-specific performance stats, awards, records, honors, and achievements that you choose to add to your profile.

Why: To present a complete athlete profile to potential employers and to power our AI skill translation engine (which converts athletic achievements into career competencies).

Social Media Metrics

What: Follower counts and engagement rates from social accounts you explicitly connect (Instagram, TikTok, Twitter/X, YouTube). We do not access your DMs, private posts, or account passwords.

Why: To calculate your Brand Value Score for NIL deal pricing guidance. Social reach is a primary factor in NIL market valuation.

NIL Deal Records

What: Sponsor/brand information, deal type (social post, appearance, endorsement, etc.), compensation amount, contract dates, deliverables, compliance approvals.

Why: To provide NIL compliance tracking, documentation for institutional review, and to satisfy state disclosure requirements where applicable. This data is yours — we are the custodian, not the owner.

AI-Derived Scores & Translations

What: Brand Value Score (0–100 composite), Fair Market Value (FMV) range estimates for NIL deals, translated career skill competencies derived from your athletic experience.

Why: To give athletes and brands a market reference point for NIL pricing, and to give employers a framework for understanding how athletic experience maps to workplace skills. These are estimates, not determinations.

Season Calendar & Availability

What: Practice schedules, competition seasons, travel blocks, off-season periods.

Why: To match athletes with internships and jobs that are compatible with athletic commitments. Employers in our system can filter for "athlete-available" windows to find candidates who can actually take on the role.

2NIL Data Handling

Your NIL data — deal amounts, sponsor identities, brand value scores, and compliance records — is among the most sensitive data on our platform. We treat it with the strictest protections.

NIL Data Protection Principles

  • NIL deal dollar amounts are never shared with employers. Employers see only that you have NIL experience, not how much you earned.
  • Sponsor identities are not disclosed publicly. Brand partner names are only visible to your institution's compliance office for regulatory review purposes.
  • Brand Value Score is shown to employers only with your consent. You can hide it from all parties at any time in your privacy settings.
  • NIL compliance reports shared with NCAA or state bodies only as legally required. We do not proactively report NIL data to regulatory bodies unless compelled by law.
  • Completed NIL deal records are retained for 7 years for tax and regulatory compliance, after which they are securely deleted. You may request deletion of non-required records at any time.

2.1 Brand Value Score — How It's Calculated

The Brand Value Score is a proprietary composite metric (0–100) calculated using the following inputs:

  • Social Reach (40%): Total followers across connected social platforms, weighted by platform engagement rates
  • Engagement Quality (25%): Average engagement rate (likes + comments + shares / followers)
  • Sport Marketability (20%): Sport popularity factor based on national media coverage and sponsorship market data
  • Division & Competitive Level (15%): Division level, conference prominence, and team rankings

The score is recalculated monthly when social accounts are connected. You can view the inputs used for your most recent score in your dashboard under Settings → Brand Value. You can also opt out of scoring entirely — see Section 4.

2.2 Fair Market Value (FMV) Estimates

FMV estimates shown for NIL deals are AI-generated reference ranges based on historical market data. They are informational only and do not constitute a professional appraisal, legal advice, or a guaranteed payment range. Athletes should independently research market rates and consult appropriate advisors before agreeing to NIL compensation terms.

3Who Can See Your Profile

Your profile visibility is controlled by you. The table below shows the default settings and what each party can see:

You can change any of these visibility settings at any time from your dashboard under Settings → Privacy. Changes take effect immediately.

4AI Processing of Athlete Data

Dakdan Talent uses artificial intelligence to process athlete data for three specific purposes: skill translation, brand value scoring, and Fair Market Value (FMV) estimation. Here is a complete breakdown of what AI does with your data and how to opt out.

Skill Translation

Converts your athletic experience (positions held, awards, leadership roles) into career competencies that employers understand. Example: "Quarterback" → strategic decision-making, performance under pressure, team leadership.

Brand Value Scoring

Calculates your 0–100 Brand Value Score from social metrics, sport popularity, division level, and engagement data. Used for NIL deal pricing guidance only.

FMV Estimation

Generates market-rate price ranges for NIL deals based on comparable deals in our anonymized database and your Brand Value Score. This is an estimate, not a guaranteed valuation.

4.1 AI Transparency Commitments

  • Explainability: Every AI output applied to your profile includes an explanation of the inputs and factors used. You can view this in your dashboard.
  • Audit Trail: All AI processing events are logged with timestamps and are available to you in your data export.
  • NCAA Compliance Logging: AI usage on NIL-related data is logged in a format compatible with NCAA compliance reporting requirements.
  • No Discriminatory Processing: Our AI systems do not use race, ethnicity, gender, religion, disability status, or national origin as inputs for scoring or recommendations.
  • Human Review: You may request human review of any AI-generated output applied to your profile. Contact athlete-privacy@dakdantalent.com.

How to Opt Out of AI Processing

AI processing is optional. You can disable it at any time. Note: disabling AI processing will turn off skill translation, brand value scoring, FMV estimates, and AI-powered job matching.

  1. Step 1: Log in to your Dakdan Talent athlete account.
  2. Step 2: Navigate to Settings → Privacy & Consent.
  3. Step 3: Toggle off "Allow AI processing of my profile."
  4. Step 4: Confirm. All AI processing of your data will stop within 24 hours. Existing AI-derived scores will be removed from your profile.

Alternatively, email athlete-privacy@dakdantalent.com with the subject line "AI Opt-Out" and we will process your request within 5 business days.

5FERPA Interaction for College Athletes

The Family Educational Rights and Privacy Act (FERPA) protects educational records held by educational institutions. Here is how FERPA interacts with your use of Dakdan Talent:

What Dakdan Talent Is

Dakdan Talent is a third-party service provider that your university may designate as a "school official" under FERPA when your university uses our platform. In that capacity, we may receive certain student directory information and athletic records from your institution.

What Data We Can Receive from Your Institution

Only directory information (name, enrollment status, degree program, athletic participation) and data you have explicitly consented to share. We do not receive grades, disciplinary records, financial aid information, or other protected FERPA records without your direct consent.

Your FERPA Rights

You retain all your FERPA rights. You can request that your institution restrict what data they share with Dakdan Talent by contacting your university's Registrar. You can also request that we delete any data we received from your institution by emailing athlete-privacy@dakdantalent.com.

NIL Data is Separate from Educational Records

Data you directly enter into Dakdan Talent (including NIL deal records, athletic stats, and social media metrics) is not an "educational record" under FERPA — it is data you voluntarily provided to us as a direct user. Your FERPA rights apply to data originating from your educational institution, not to data you generate by using our platform directly.

7Your Rights as an Athlete

As a Dakdan Talent athlete user, you have the following rights regarding your personal data. These rights apply regardless of your state of residence (though additional rights may apply in California, Virginia, Colorado, Connecticut, Utah, and other states with consumer privacy laws).

Request a complete copy of all personal and athlete data we hold about you, including your profile data, NIL records, AI processing logs, and consent history.

Export a complete, machine-readable copy of all your athlete data (JSON or CSV format) to take with you to any other platform. This includes all profile data, NIL records, and AI processing history.

Restrict all employer access to your profile at any time. You can also restrict access to specific data types (e.g., allow employers to see your sport but not your stats) via granular privacy controls in your dashboard.

8High School Athlete Protections

High School Athletes: Enhanced Protections Apply

High school athletes receive all standard athlete privacy protections PLUS additional safeguards described in this section. These protections apply to all athletes under 18 regardless of their state's NIL rules.

8.1 Parental Consent Requirements

All high school athletes (or any athlete under 18) must have a parent or legal guardian who:

  • Creates a linked guardian account or co-approves the athlete's account during registration
  • Provides verified consent for the minor to use the platform
  • Co-signs any NIL deal entered into the platform's NIL management system
  • Receives all platform communications sent to the athlete's account
  • Can review, modify, or delete all data associated with the athlete's account at any time

8.2 State Eligibility Warning System

When a high school athlete attempts to enter an NIL deal into the platform, our system will display a state-specific eligibility warning based on the athlete's stated state of residence and school. These warnings:

  • Are informational only and do not constitute an eligibility determination
  • Are based on our current understanding of state rules and may not reflect recent changes
  • Do not substitute for verification with the athlete's school, athletic director, or state athletic association
  • Will require acknowledgment by both the athlete and guardian before proceeding

Dakdan Talent is not responsible for any loss of athletic eligibility resulting from NIL activities conducted by high school athletes using our platform. See Terms of Service Section 21 for the full eligibility disclaimer.

8.3 Additional High School Athlete Data Protections

  • Default Private Profile: High school athlete accounts default to private at creation. A guardian must approve any change to public visibility.
  • No Direct Employer Outreach: Employers cannot send direct messages to athletes identified as under 18. All employer interest is routed through the platform's supervised system with guardian visibility.
  • No Marketing Communications: We do not send promotional emails directly to under-18 accounts. All marketing communications go to the guardian's verified address.
  • Data Minimization: We do not build behavioral advertising profiles for under-18 users. Data collected is limited to what is necessary for career development and NIL compliance features.
  • Guardian Deletion Rights: A guardian can request complete deletion of a minor's account and all associated data at any time, with a 30-day processing window.
