1What is the EU-US Data Privacy Framework?

The EU-US Data Privacy Framework (DPF) is a mechanism that enables U.S. companies to receive personal data from the European Union in compliance with EU data protection requirements. It was established following the invalidation of the Privacy Shield framework and addresses concerns raised in the Schrems II decision.

The DPF provides a legal basis for transatlantic data flows by requiring participating U.S. companies to commit to robust data protection obligations and enforcement mechanisms.

We provide meaningful choices about:

  • Whether your data is disclosed to third parties
  • Whether your data is used for purposes materially different from those for which it was collected
  • Opt-out mechanisms for marketing communications
  • Opt-in consent for sensitive data processing (health, biometric, etc.)

Accountability for Onward Transfer

When we transfer data to third parties, we:

  • Enter into contracts requiring equivalent protection
  • Verify third-party compliance with DPF Principles or equivalent safeguards
  • Remain liable if third parties process data inconsistently with DPF Principles
  • Take reasonable steps to remediate unauthorized processing

3Scope of Our DPF Certification

Covered Data

Our DPF certification covers personal data transferred from the European Union, European Economic Area (EEA), and Switzerland to the United States, including:

  • Candidate profile information (name, contact details, resume, work history)
  • Employer account data (company information, hiring team contacts)
  • University partner data (institution details, authorized representatives)
  • Platform usage data (analytics, activity logs)
  • Communication data (messages, support requests)
  • Payment information (billing details, transaction records)

  • Mobile applications (iOS and Android)
  • API services for integrations

Swiss-US and UK Extension

DAKDAN Talent also participates in the Swiss-US Data Privacy Framework and adheres to the UK Extension to the EU-US DPF, providing equivalent protections for personal data transferred from Switzerland and the United Kingdom.

4Complaint Resolution and Dispute Mechanisms

Step 1: Contact Us Directly

Response Time: We will acknowledge receipt within 5 business days and provide a substantive response within 45 days.

Step 2: Independent Dispute Resolution

If your complaint is not resolved through our internal process, you may invoke binding arbitration through our independent dispute resolution provider:

Cost: Free of charge to EU/EEA/Swiss/UK individuals

Step 3: Binding Arbitration

Under certain conditions, you may invoke binding arbitration before the Data Privacy Framework Panel when:

  • Your complaint involves human resources data transferred in the employment context
  • You have exhausted all other recourse mechanisms
  • The arbitration option is elected by you or DAKDAN Talent

Step 4: FTC Enforcement

DAKDAN Talent is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission (FTC). EU individuals may also file complaints with:

5Additional Data Transfer Mechanisms

In addition to our DPF certification, we implement multiple data transfer safeguards:

Standard Contractual Clauses (SCCs)

We use the European Commission's Standard Contractual Clauses (2021 version) as an alternative transfer mechanism for enterprise customers and partners.

Binding Corporate Rules (BCRs)

For intra-group transfers, we are developing Binding Corporate Rules approved by EU data protection authorities (planned for Q3 2026).

Adequacy Decisions

Where applicable, we rely on adequacy decisions for transfers to countries recognized by the European Commission as providing adequate protection.

Consent

In specific cases, we may seek your explicit consent for international data transfers when no other mechanism applies.

6Limitations on DPF Coverage

Government Access Safeguards

While the DPF includes enhanced safeguards regarding U.S. government access to data, DAKDAN Talent may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. Such disclosures will be limited to what is legally required and permissible under DPF Principles.

Exceptions to DPF Coverage

The DPF does not apply to:

  • Data that does not originate from the EU/EEA, Switzerland, or UK
  • Anonymous or aggregated data that cannot identify individuals
  • Public information available in the public domain
  • Employment-related data of non-EU employees (separate HR Privacy Shield principles apply)

7Verification and Annual Recertification

DAKDAN Talent commits to:

  • Annual self-assessment of DPF compliance
  • Verification by independent auditors (annually)
  • Prompt recertification before expiration
  • Maintaining public records of certification status
  • Transparency reporting on data requests and transfers

Next Recertification Due

Our next DPF recertification is scheduled for January 15, 2027. We will complete the recertification process at least 30 days prior to expiration to ensure continuous coverage.

8Changes to This Notice

We may update this DPF Notice to reflect changes in our practices or legal requirements. Material changes will be communicated through:

  • Prominent notice on our website
  • Email notification to registered users
  • Updated "Last Updated" date at the top of this notice
